Mali wants you to know that the User’s privacy is significantly important to us. This page informs the User of our policies regarding the collection, use, and disclosure of personal data when the User uses our Services and the choices the User has associated with that data.
These Privacy Policy, along with our Terms of Use, are an agreement between Mali (“Mali”, “us”, “we” or “our”) and you (“User”, “you” or “your”). This Agreement sets forth the Privacy Policy of the User’s use of the Mali mobile application and any of its products, website, content, communications, or Services (collectively, “Mobile Application”, “Application” or “Services”). The User acknowledges that the User has read this Agreement and agrees to all its Privacy Policy, along with Terms of Use. By using Mali or its Services, the User agrees to be bound by this Agreement. If the User does not agree to abide by the terms of this Agreement, the User is not authorized to use or access Mali and its Services.
Changes and Amendments
Mali reserves the right to modify this Agreement or its policies relating to Mali or Services at any time, effective upon posting of an updated version of this Agreement on Mali. When Mali does, Mali will revise the updated date at the bottom of this page. Continued use of Mali after any such changes shall constitute the User’s consent to such changes.
Where required by applicable law or if we think it is important to inform you, we may notify you in the event of changes to this Agreement or its policies relating to Mali or Services. The notification could be made by email or other common mode of communications or we may seek your consent to those changes.
Children’s Privacy
Mali and the Services do not address anyone under the age of 20. Mali does not knowingly collect personal information from children under 20 via the Services. Mali may, however, collect information about children from their parents who are using the Services. Only parents are allowed to create accounts and profiles and post personal content on our sites and Services. If a parent becomes aware that his or her child has provided us with information without their consent, he or she should contact us at [email protected]. Mali will delete such information within a reasonable time.
Parents or guardians have full responsibility for action and use of any information provided through our Services for a minor. Users may not provide information about the child without getting the consent of the rightful guardian.
Link to Other Sites and Applications
Although Mali may be linked to other sites, links, or mobile applications. Mali is not responsible for or has control over these other sites or mobile applications and their privacy policy. The User should carefully review the privacy policy, the legal statements, and other conditions of use of any sites or mobile application separately.
Information Collection and Use
When User registers with us and uses the Application or Services, the User generally provides
(a) the User’s first and last name, email address, age, username, password, date of birth, and other registration information;
(b) information the User provides us when the User contacts us for help;
(c) information the User enters into our system when using the Application, such as contact information, and photos;
(d) access to certain personal information stored by third parties including social media, such as Facebook, Google+, LINE, and Twitter;
(e) the User’s personal health and medical information such as wellness condition, height, weight, due date, life stage, medical history, medical examination, consultation history, booking, appointments, prescriptions, notes, description of medical services rendered, medical reports, billings, insurances, vaccination records and date of the User’s last menstrual period;
(f) the babies or children’s health information such as name or nickname, height, weight, head circumference, blood type, developmental progress, sleep pattern, vaccination records, insurances, medical records and eating habits;
(g) details of the products and services you have purchased with us or received from us, payment information such as credit card details, payment method, payment history, payor name, and other payment details;
(h) contact history, chat history, event booking, group chat messages, your shared content, registration and participation in events;
(i) content preferences, your interests and bookmarking;
(j) technical information and personal activities/preference collected when you use this application and group chat on Line application, any social media platforms, such as user’s unique identification on social media platforms, location and activities when you use the application; and
(k) personal data of a third party that you provide to us in connection with the use or purchase of our products and services, or for referrals.
When you provide us with personal data of any other person (including without limitation family members), you represent and warrant that you have verified the accuracy and completeness of personal data of such other person, you have informed our privacy policy and obtained such person’s prior consent or be able to rely on other legal basis on the disclosure of such personal data to the extent that such consent is not required under applicable laws and regulations.
The provision of your personal data is voluntary but failure to do so may inhibit us to provide you our products or services.
Log Data
Mali wants to inform the User that our Services may collect certain information automatically (through third party products) on the User’s phone called Log Data. This Log Data may include, but not limited to, information such as the User’s device Internet Protocol (“IP”) address, device name, devices unique device ID, operating system version, the type of mobile Internet browsers that the User uses, information about the way the User uses the Services, the configuration of the app when utilizing our Services, the time and date of the User’s use of the Services, and other statistics.
Cookies
By using our Services the User consents that Mali may use cookies and third-party Services, and collect the User’s usage data and history under a unique identifier, for the purposes of tracking, analysis, and improvement of our Services for the User’s better experience.
Purposes for Collection, Use or Disclose Personal Data
- to provide our products and services to you;
- to process your requests, inquiries or forms you may submit to us from time to time;
- to design new or enhance our existing products and services;
- to communicate with you or provide recommendations regarding products and services to you or offer you products and services;
- to improve our products and services or provide technical support;
- for advanced data analytics and statistical research;
- for prevention of misconduct or prohibited activities;
- to monitor your behavior, conduct analysis of your use of our application and your preferences and provide targeted advertising;
- to meet requirements imposed by applicable laws or regulations, for reporting to competent authorities or regulators, regulatory compliance, and audit reviews;
- to assist in law enforcement, and investigation purposes; and
- to perform other necessary activities relating to any of the above purposes.
For purposes other than the above, we will inform new purposes and obtain your consent.
How We Process Your Personal Data and Who May Be Provided With Your Personal Data
Mali keeps User’s personal information and collected data confidential and does not disclose or use it, except for the various purposes:
To improve our Products, Services and understand your needs and behavior. By using our app and Services, Mali collects, stores, and uses personal and non-personal data and may transmit some of it to third-party services and advertisers. Mali does this to understand the User’s needs, behavior, and the User’s use of our Services, to analyze bugs, fix issues, or improve our content and advertising. Mali does this with the aim to improve our Products or Services to provide the User with a better experience
Mali does not share personal data with third-party services that directly identifies the User, or contain any information that could be used to contact the User unless such third party can ensure that they treat your personal data in the same manner required by this privacy policy. If third parties have access to the User’s Personal Data, then only to perform tasks to improve the experience on our behalf. They are obligated not to disclose or use that data for any other purpose than to improve the User’s experience with Mali.
To provide customer support. Our support team may view the User’s data and personal information if doing so is required to answer the User’s question or troubleshoot a problem. Mali may also ask the User for additional information if needed. The access to the User’s personal information is limited to the support team to resolve the issue or to improve the services. Only person who needs to know such information to perform their tasks may have access to your personal information such as medical professionals and group admins. Your personal information may be shared to any member of Mali Group of Companies, our professional advisors such as auditors or consultants, any party to whom you have consented the disclosure of your personal data and any other third parties permitted under applicable law.
We may also share data to any law enforcement agencies, court, regulatory bodies, or any other person in any jurisdiction to whom Mali or another member of the Mali Group must disclose data under a legal or regulatory obligation.
Cross-border Transfer
Your personal data may be transferred to, stored or processed by Mali or our affiliates or Mali Group of Companies or our partner or our service providers who may be located in or outside Thailand.
Your personal data will only be transferred to other locations, where we are satisfied that adequate levels of protection exist to protect the security of your personal data and such transfer of personal data shall be securely transferred and protected in accordance with the personal data protection standards.
Where required under relevant law, we may seek your consent to the transfer of such personal information.
Your Rights With Respect To Personal Data
- Right to access and obtain copy of your personal data;
- Right to receive personal data concerning you;
- Right to rectify or to require Mali to correct your personal data;
- Right to object the collection, use, or disclosure of the personal data;
- Right to erasure or to request deletion of your personal data or to anonymize the personal data to become the anonymous data;
- Right to restrict or to request that the processing of your personal data be restricted;
- Right to data portability; and
- Right to withdraw your consent
Use of personal data for original purposes
For personal data collected before the effectiveness of the applicable data privacy laws, we are entitled to continue collecting and using such personal data in accordance with the original purposes. If you do not wish us to continue collecting and using your personal data, you may notify us to withdraw your consent at any time.
Miscellaneous
Notification to you about our Services:
Mali may notify the User of important updates or changes about our Services, products, features, partners, our Privacy Policy, our Terms of Use, or any other important news. The User will be automatically signed up to receive these regular emails, messages, notification, or newsletters from us. By doing this, Mali wants to ensure that the User will not miss out on our newsworthy changes, and updates.
Advertising:
The User may encounter ads in our Services. These ads may be for our own products or services or for those of our advertising partners or affiliates. Mali may share User’s information with third parties, such as ad networks, web analytics companies, and social networking platforms, including personal information and non-personal information in an aggregate and anonymous format combined with the information Mali collects from other users. Regarding this, the User will not be personally identifiable from the User’s aggregate, personal, or non-personal information.
Change of Ownership
Mali has the right to transfer or disclose the User’s personal information in connection with a merger, financing, acquisition, dissolution transaction, sale, transfer, divestiture of all or a portion of the ownership of our business, assets, or Services.
In the event that we sell a business, we will make efforts to ensure that the purchaser will treat your personal data in the same manner or as minimum required by this privacy policy.
Deletion of Personal Information
The User can request the deletion of the User’s personal information or withdraw consent to collect, use, or disclose personal data by giving us notice. If the User wants us to delete all information stored at Mali or withdraw consent, please email us at [email protected]
If you withdraw your consent to collect, use, or disclose your personal data for non-marketing reasons, we may be unable to provide products/services to you and you may be required to delete your accounts and unable to enjoy future benefits.
Security
Mali is concerned about the confidentiality of the User’s information. Mali provides physical, electronic, and procedural safeguards to protect the information Mali processes, maintains, and stores. For example, Mali limits access to the information to authorized employees and contractors who need to know that information in order to perform their tasks, operate, develop or improve our Application. Please be aware that, although Mali endeavors to provide reasonable security for information that Mali processes and maintains, no security system can prevent all potential security breaches.
Retention Period of Personal Data
We need to store your personal data while you are our user. After the end of the relationship with us or once you agree to delete your account with us, we will only store your personal data for a period of time that is reasonable for each type of personal data or as required by applicable laws.
Direct Marketing Purposes
To provide you with information about our products and services, Mali and its group of companies would like to use your personal for these following purposes:
- contact you for offering or providing products, services, and benefits to you; and
- send you direct marketing communications about our or our partner’s products, services, reward, loyalty and privilege programs;
It can be done via email marketing, SMS marketing, telemarketing or other modes of communications.
We also may share your personal data with our partners so that they can send you direct marketing communication in relation to the products and services they have.
