Mali Terms of Use

Thank you for your interest in Mali Pregnancy & Parenting (in the following just “Mali”).
These Terms of Use (“Terms” or “Agreement”), along with our Privacy Policy, are an agreement between Mali (“Mali”, “us”, “we” or “our”) and you (“User”, “you” or “your”).
This Agreement sets forth herewith the general terms and conditions of your use of the Mali mobile application and/or any of its products, website, content, communications, or services (collectively, “Mobile Application”, “Application”, or “Services”).
Mali does not offer medical advice
Mali and our Services provide information for educational and information purposes only. Our Services do not give medical advice whatsoever. Mali also does not give a warranty that any of the information, our articles, tips, and answers are accurate or up to date. Even if the statement Mali makes is accurate, it may not apply to your specific symptoms, pregnancy, body, or child.
The User agrees;
- not to rely on the information in the Application and the Services as medical advice.
- acknowledges that the information in the Application and the Services is general; therefore, the User agrees that the aforesaid information shall not be substituted for the advice from any qualified medical professional.
- that the information provided in the Application and the Services is the general information about pregnancy, early child development, parenting, and other relevant information, therefore, the User is aware that the use of any information from the Application and/or the Services shall be subjected to the medical advice from a professional doctor. Mali shall not be liable for any responsibility for the results or consequences of any attempt to use or adopt any of the information in the Application and the Services.
- that the User will only use the Application and/or the Services for education purposes, research for general information only, not to seek medical opinion or advice.
- that Mali reserves the right to immediately delete any information and/or the User accounts of any User who commits an offense under the Computer Crime Act and/or any applicable law, in case Mali warns and notify the said User, and the User does not correct the said default within the limited time set by Mali. In addition, Mali is not responsible for any damage caused by the said actions of the user, and the User agrees to be solely legally responsible for all Civil cases and Criminal cases.
MALI’S SERVICES ARE NOT APPROPRIATE FOR MEDICAL ADVICE OR EMERGENCIES. IF YOU NEED MEDICAL ADVICE OR THINK YOU HAVE A MEDICAL OR MENTAL HEALTH EMERGENCY, GO TO THE NEAREST HOSPITAL OR CONTACT YOUR DOCTOR IMMEDIATELY.
Disclaimer
Mali is the Application and/or the Services which provide general information about pregnancy, early child development, parenting, and other relevant information. The User must use the aforesaid information only to be as the general information. In case used for medication diagnosis, the User agrees to have the confirmation from the physician and/or doctor. Mali is not involved in the results of the information being used without the doctor’s confirmation.
Mali provides a variety of information, such as articles, tips, recommendations, posts, text, quotes, graphics, photographs, videos, data, software, surveys, messages, and other materials (“Content”). Some of the Content is provided by Mali or its partners (“Suppliers”), and other Content is provided by Users, such as any community features or surveys. Mali does not guarantee and is not responsible for the accuracy, or the completeness of any content. Any opinions, advice, statements, or other information expressed or made available by the Users or third parties, on their own, are the responsibility of those respective Users or other third parties.
Mali does not recommend or endorse any products, advice, procedures, comments, messages, advertisements, or any other information mentioned on our Services. Relying on any information provided by our Services is solely at your own risk.
Accounts and membership
If the User creates an account in Mali, the User is responsible for maintaining the security of the User’s account and is fully responsible for all activities that occur under the account and any other actions taken in connection with it.
Providing false contact information of any kind may result in the termination or deletion of your account. The User must immediately notify us of any unauthorized uses of your account or any other breaches of security. Mali will not be liable for any acts or omissions by the User, including any damages of any kind incurred as a result of such acts or omissions.
Mali may suspend, disable, or delete your account (or any part thereof) if Mali determines that the User has violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If Mali deletes your account for the foregoing reasons, the User may not re-register for our Services. Mali may block the User’s email address and Internet protocol address to prevent further registration.
Children’s Privacy
Mali and the Services do not address anyone under the age of 20. Mali does not knowingly collect personal information from children under 20 via the Services. Mali may, however, collect information about children from their parents who are using the Services. Only parents are allowed to create accounts and profiles and post personal content on our sites and Services. If a parent becomes aware that his or her child has provided us with information without their consent, he or she should contact us at [email protected]. Mali will delete such information within a reasonable time.
Parents or guardians have full responsibility for action and use of any information provided through our Services for a minor. Users may not provide information about the child without getting the consent of the rightful guardian.
Community, chat and online consultations
Mali’s Services are providing consultation online via the app, chat, and other forms on a secure Internet connection.
Mali is not a medical service provider. All virtual consultations provided through our app, forum, website, or third party application associated with Mali, by members of our care team or by specialists associated with Mali, are for educational purposes only. Mali also does not facilitate any medical consultation, diagnosis or treatment. To get medical diagnosis, treatment or other forms of medical consultation, please always contact your doctor or hospital.
Mali, the care team, and external specialists can only provide educational information, through the services, so that the user can preliminary assess their own conditions. Users who share personal information with Mali, members of the care team or specialists, always do so at their own risks. Any educational information provided by the care team or specialists is not under the control of Mali. After using Mali’s Services, the User shall discuss with their own doctor or hospital any educational information provided by or through Mali.
The provision of any information received from the service does not create a licensed medical professional/patient relationship, between Mali and you, and does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition.
User content
Mali does not own any data, information or material (“Content”) that the User submits in Mali in the course of using the Service. The User shall have sole responsibility for the accuracy, quality, integrity, legality, appropriateness, and intellectual property ownership of all submitted Content. Mali may, but have no obligation to, monitor Content submitted or created using our Services by the User. Unless specifically permitted by the User, the User’s use of Mali does not grant us the license to use, reproduce, adapt, modify, publish or distribute the Content created by the User or stored in the User’s account for commercial, marketing, or any similar purpose. But the User grants us permission to use, access, duplicate, distribute, store, transmit, reformat, display, and perform the Content of the User’s account for the purpose of providing the Services to the User. Without limiting any of those representations, Mali has the right to, in our own sole discretion, refuse or remove any Content that, in our reasonable opinion, violates any of our policies or is in any way objectionable.
Prohibited uses
In addition to other terms as set forth in the Agreement, the User are prohibited from using Mali or its Content: (a) for any unlawful purpose; (b) to solicit others to participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, race, age, origin, or disability; (f) to submit false or misleading information; (g) to transmit viruses or any other type of malicious code that may be used in any way that will affect the functionality or operation of the Service or of any related mobile application, other mobile applications, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to harm the security features of the Service or any related applications, or the Internet. Mali reserves the right to terminate the User’s use of the Service.
Backups
Mali performs regular backups of the Content, however, these backups are for our own administrative purposes only and are in no way guaranteed. The User is responsible for maintaining the User’s own backups of User’s data. Mali does not provide any sort of compensation for lost or incomplete data in the event that backups do not function properly. Mali will do our best to ensure complete and accurate backups but assume no responsibility for this duty.
Links to other applications or websites
Mali may contain links to other websites, mobile apps, or to third-party services. Such links are provided for your convenience only, and the User accesses them at the User’s own risk. Mali is not, directly or indirectly, implying any approval, sponsorship, endorsement, or affiliation with any linked mobile application or websites, unless specifically stated herein. Mali does not warrant the offerings of, any businesses or individuals or the content of their mobile applications or websites. Mali does not assume any responsibility or liability for the actions, products, services, and content of any other third parties. The User should carefully review the legal statements and other conditions of use of any mobile application or website which the User accesses through a link from Mali. The User’s linking to any other application or website is at the User’s own risk.
Mali welcomes links to us but only in strict accordance with our terms and conditions. Mali reserves the right to revoke the User’s right to link to Mali upon notice. If the User receives such a notice from us, the User agrees to discontinue the User’s link to the Services.
Advertisements
During the use of Mali, the User may enter into correspondence with or participate in promotions of advertisers showing goods, hyperlinks, advertisements, or services. Any such activity, and any terms, conditions, warranties, or representations associated with such activity, is solely between the User and the applicable advertiser. Mali shall have no liability, obligation, or responsibility for any such correspondence, purchase, or promotion between the User and any such third party. The User’s use of such sites, including their content, products, or services, is solely at the User’s own risk.
Mali is not implying any approval, association, endorsement, or affiliation with any content provided by or linking to third-parties sites or applications. Mali does not assume any responsibility or liability for the actions, products, services, content, any loss or damage of any kind from any dealings between the User and any third parties, or as a result of the presence of such third parties’ information, content, or services.
Intellectual property rights
This Agreement does not transfer to the User any intellectual property owned by Mali or third parties. All trademarks, service marks, graphics, and logos used in connection with Mali or Services are trademarks or registered trademarks of Mali or Mali licensors. Other trademarks, service marks, graphics, and logos used in connection with the Services may be the trademarks of other third parties. The User’s use of our Services grants the User no right or license to reproduce or otherwise use any Mali or third-party trademarks. The User agrees not to remove or obscure any copyright notices displayed on, used in, or in conjunction with the Content. The User also agrees that the User has no right to access, view, or alter any source code of Mali.
Limitation of liability
If the User is dissatisfied with Mali, or any materials, products, content, or services, the User’s sole and exclusive remedy is to discontinue using our Services.
In no event will Mali or any of our affiliates, or any of our or their directors, employees, agents, or content or service providers, be liable for any damages (including, without limitation, direct, indirect, special, incidental, consequential, exemplary or punitive damages) arising from, or directly or indirectly related to, the use of, or the inability to use, the site (or the content, materials, and functions provided as part of the site), whether in an action of contract, negligence, or strict liability, even if Mali knew, should have known or had been advised of the possibility of such damages. Notwithstanding and without limiting the foregoing, the User agrees that our liability and the liability of our affiliates, and of any of our or their directors, officers, employees, or content or service providers, if any, arising out of any kind of legal claim in any way relating to the use of the site, will not exceed the amount the User has actually paid to us. Because some countries or states do not allow the exclusion or limitation of certain categories of damages, the above limitations may not apply to the User. In such states, our liability and the liability of our affiliates, and our and their directors, employees, agents, or content or service providers, is limited to the fullest extent permitted by such state law.
Indemnification
The User agrees to hold Mali and its affiliates, directors, officers, employees, partners, and representatives harmless from and against any liabilities, damages, or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to the User’s Content, the User’s use of the Mali or Services or any willful misconduct on the User’s part.
Severability
All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws. They are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid, or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force.
Dispute resolution
The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Bangkok, Thailand. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the state and federal courts located in Bangkok, Thailand. The User hereby submits to the personal jurisdiction of such courts. The User hereby further waives any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
Changes and amendments
Mali reserves the right to modify this Agreement or its policies relating to Mali at any time, effective upon posting of an updated version of this Agreement in Mali. When Mali does Mali will revise the updated date at the bottom of this page. Continued use of Mali after any such changes shall constitute the User’s consent to such changes. Acceptance of these terms
The User acknowledges that the User has read this Agreement and agrees to all its terms and conditions. By using Mali or its Services, the User agrees to be bound by this Agreement. If the User does not agree to abide by the terms of this Agreement, the User is not authorized to use or access Mali and its Services.
