Mali Terms of Use

Thank you for your interest in a service by Mali Family Health Co., Ltd. (in the following, just “Mali”).
Mali is operated by Mali Family Health Co., Ltd., 130-132 Sindhorn Building Tower 2, 10th Floor, Wireless Road, Lumpini, Pathumwan, Bangkok 10330, Thailand. If you have any questions, please contact us at [email protected].

This Agreement sets forth herewith the general terms and conditions of your use of any websites or mobile applications operated by Mali, including Mali Pregnancy & Parenting, Mali Fertility, and DekDuangDee, and their products, websites, content, communications, or services (collectively, “Mobile Application”, “Application”, or “Services”).

Mali does not offer medical advice
Mali and our Services provide information for educational and informational purposes only. Our Services do not give medical advice whatsoever. Mali also does not give a warranty that any of the information, our articles, tips, and answers are accurate or up to date, and the content is not peer-reviewed or verified by licensed medical professionals prior to publication. Even if the statement Mali makes is accurate, it may not apply to your specific symptoms, pregnancy, body, or child.

The User agrees;
not to rely on the information in the Application and the Services as medical advice.

acknowledges that the information in the Application and the Services is general; therefore, the User agrees that the aforesaid information shall not be substituted for the advice from any qualified medical professional.

that the information provided in the Application and the Services is the general information about pregnancy, early child development, parenting, and other relevant information, therefore, the User is aware that the use of any information from the Application and/or the Services shall be subjected to the medical advice from a professional doctor. Mali shall not be liable for any responsibility for the results or consequences of any attempt to use or adopt any of the information in the Application and the Services.

that the User will only use the Application and/or the Services for educational purposes, research for general information only, not to seek medical opinion or advice.

Termination and Content Removal
Mali reserves the right to delete, disable, or restrict access to any Content or User accounts that we reasonably believe violate the Computer Crime Act B.E. 2550, infringe third-party intellectual property, or damage Mali’s corporate reputation. Where the breach is serious or the law requires it, we may act immediately. Otherwise we will notify you first and give you the chance to respond. The effect on purchases is set out in “What happens to purchases when an account ends”. Mali is not liable for loss caused by a takedown made in good faith under this clause, except as that section provides.

MALI’S SERVICES ARE NOT APPROPRIATE FOR MEDICAL ADVICE OR EMERGENCIES. IF YOU NEED MEDICAL ADVICE OR THINK YOU HAVE A MEDICAL OR MENTAL HEALTH EMERGENCY, GO TO THE NEAREST HOSPITAL OR CONTACT YOUR DOCTOR IMMEDIATELY.

Disclaimer
Mali is the Application and/or the services that provide general information about pregnancy, early child development, parenting, and other relevant information. The User must use the aforesaid information only as general information. In case used for medication diagnosis, the User agrees to have the confirmation from the physician and/or doctor. Mali is not involved in the results of the information being used without the doctor’s confirmation.

Mali provides a variety of information, such as articles, tips, recommendations, posts, text, quotes, graphics, photographs, videos, data, software, surveys, messages, and other materials (“Content”). Some of the Content is provided by Mali or its partners (“Suppliers”), and other Content is provided by Users, such as any community features or surveys. Mali does not guarantee and is not responsible for the accuracy or completeness of any content. Any opinions, advice, statements, or other information expressed or made available by the Users or third parties, on their own, are the responsibility of those respective Users or other third parties.

Mali does not recommend or endorse any products, advice, procedures, comments, messages, advertisements, or any other information mentioned on our Services. Relying on any information provided by our Services is solely at your own risk.

Accounts and membership
If the User creates an account in Mali, the User is responsible for maintaining the security of the User’s account and is fully responsible for all activities that occur under the account and any other actions taken in connection with it.

Providing false contact information of any kind may result in the termination or deletion of your account. The User must immediately notify us of any unauthorized uses of your account or any other breaches of security. Mali will not be liable for any acts or omissions by the User, including any damages of any kind incurred as a result of such acts or omissions.

Mali may suspend, disable, or delete your account (or any part thereof) if Mali determines that the User has violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If Mali deletes your account for the foregoing reasons, you may not re-register for our Services. Mali may block the User’s email address and Internet protocol address to prevent further registration.

Premium features and purchases

Free and paid features. Some features of our apps, including DekDuangDee and Mali, are free. Others (“Premium Features”) require a one-time purchase or a subscription. Before you buy, the app shows what is included, the price and, for subscriptions, the billing period.

Subscription. A DekDuangDee subscription gives you, for as long as it is active: (a) name matching that uses the parents’ names, so suggestions fit your family; (b) unlimited swipes, with no daily limit on the names you can view; (c) access to our full name database, including names we add over time, subject to fair use; and (d) any other subscriber benefits shown on the purchase screen. Free features stay available without a subscription.

Store billing. Purchases are made through your Apple App Store or Google Play account (the “Store”). The Store, not Mali, charges you, and the Store’s payment terms apply. Mali does not receive or store your card details. Prices are shown in your local currency and include VAT where the Store collects it.

Automatic renewal. A subscription renews automatically for the same period, at the price then in effect, unless you cancel at least 24 hours before the current period ends. The Store charges the renewal within 24 hours before the period ends.

Free trials and introductory offers. Where we offer a free trial or introductory price, the purchase screen shows how long it lasts and the price that applies afterwards. The trial converts to a paid subscription at that price unless you cancel before it ends. Each Store account may use a trial once.

How to cancel. You can cancel at any time. On iPhone or iPad: Settings > your name > Subscriptions. On Android: Google Play > profile icon > Payments and subscriptions > Subscriptions. Where available, the app also links to these pages. Deleting the app or your account does not cancel a subscription. After you cancel, you keep access until the end of the period you have paid for.

Refunds. Refunds are handled under the Store’s refund policy. For App Store purchases, only Apple can grant a refund; request one at reportaproblem.apple.com. For Google Play purchases, request a refund through Google Play. Nothing in this Agreement limits any right to a refund or other remedy that Thai consumer law gives you and that cannot be excluded.

Price changes. We may change the price of a subscription for future billing periods. The Store will notify you in advance. Where the Store or the law requires your consent, the new price applies only if you accept it; otherwise your subscription ends when the current period ends.

One-time purchases. One-time purchases, such as personalised reports or analyses, are delivered to your account immediately after payment. Because delivery is immediate, they are not refundable except as the Store’s policy or the law provides.

Restoring purchases. Purchases are linked to your Store account and your Mali account. Use “Restore purchases” in the app after reinstalling or changing device. A purchase made on one platform may not be available on the other.

Changes to Premium Features. We may add, change or remove Premium Features. If a change materially reduces what you have already paid for, you may cancel and we will refund the unused part of the current period.

Who may buy. You must be at least 20 years old, or the age of majority where you live, to make a purchase.

Full access. Where Mali advertises “full access” or “unlimited access” to content or data, this means access for your normal personal use through the app’s features, subject to fair use. It does not allow scraping, bulk downloading, automated extraction or copying of our content or database, or any commercial use. Mali may apply reasonable limits, or suspend access, to prevent such use.

Licence to use the apps
Subject to this Agreement, Mali grants you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use our apps on devices you own or control, for your own non-commercial use and as the Store’s usage rules allow. Premium content, including name lists, meanings and reports, is for your family’s personal use. You may not resell, republish, scrape, or share it commercially.

Names, auspicious dates and fortune content
Names, meanings, day-of-birth suitability, auspicious dates and any fortune or compatibility content are based on traditional Thai naming principles, astrology and numerology. They reflect belief and tradition, not science, and different traditions or practitioners may reach different results. Mali does not guarantee that any name or date will bring luck, health, success or any other outcome.

This content is not medical advice. Do not plan, change or delay a birth, a caesarean section or any other medical decision because of it. Always follow your doctor’s advice.

Mali does not guarantee that a name will be accepted for registration by a district office under the Person Name Act B.E. 2505, or that it is unique or free of third-party rights. The choice of name is yours alone.

What happens to purchases when an account ends
If you delete your account, you lose access to purchased content, and any subscription keeps renewing until you cancel it in the Store. Cancel first, then delete.

If we suspend or close your account because you breached this Agreement, you lose access to Premium Features and, as far as the law allows, are not entitled to a refund. You remain responsible for cancelling the subscription in the Store.

If we discontinue an app or a Premium Feature, or close your account without a breach by you, we will give at least 30 days’ notice where practicable and refund the unused part of any period you have paid for.

Children’s Privacy
Mali and the Services are not directed to anyone under the age of 20 in Thailand, or the age of majority in the country where the user resides. Mali does not knowingly collect personal information directly from children under the applicable age of majority.

Mali may, however, collect information about children from their parents who are using the Services. Only parents are allowed to create accounts and profiles and post personal content on our sites and Services. If a parent becomes aware that his or her child has provided us with information without their consent, he or she should contact us at [email protected]. Mali will delete such information within a reasonable time.

Parents or guardians have full responsibility for the action and use of any information provided through our Services for a minor. Users may not provide information about the child without first obtaining and maintaining all necessary consents from all rightful guardians, parents, or other persons with parental responsibility.

Community, chat, and online consultations
Mali may offer in-app interactive chats, peer groups, and text-based interactions with Mali content facilitators (collectively, “Educational Support Services”).

The User explicitly acknowledges that Mali is a technology platform and is NOT a licensed medical provider, clinic, or sanatorium under Thai law. The content facilitators are strictly peer educators providing generic, non-diagnostic, and educational information to assist you in preliminary self-education. No interaction on our platform creates a doctor-patient, nurse-patient, or licensed medical professional relationship. The Educational Support Services are not a substitute for clinical diagnosis, medical advice, or emergency triage.

User content
Mali does not own any data, information, or material (“Content”) that the User submits in Mali in the course of using the Service. The User shall have sole responsibility for the accuracy, quality, integrity, legality, appropriateness, and intellectual property ownership of all submitted Content. 

Mali may, but has no obligation to, monitor Content submitted or created using our Services by the User. For Content the User submits to public or shared areas of the Service (e.g., community forums), the User grants Mali a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, and distribute such Content in any media. For all other Content, the User grants Mali a limited, non-exclusive license to access, use, duplicate, distribute, store, and transmit the Content solely for the purpose of providing the Services to the User. Without limiting any of those representations, Mali has the right to, in our own sole discretion, refuse or remove any Content that, in our reasonable opinion, violates any of our policies, including the Prohibited Uses section of this Agreement, or is in any way objectionable.

Prohibited uses
In addition to other terms as set forth in the Agreement, the User are prohibited from using Mali or its Content: (a) for any unlawful purpose; (b) to solicit others to participate in any unlawful acts; (c) to violate any international, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, race, age, origin, or disability; (f) to submit false or misleading information; (g) to transmit viruses or any other type of malicious code that may be used in any way that will affect the functionality or operation of the Service or of any related mobile application, other mobile applications, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to harm the security features of the Service or any related applications, or the Internet. Mali reserves the right to terminate the User’s use of the Service.

Backups
Mali performs regular backups of the Content; however, these backups are for our own administrative purposes only and are in no way guaranteed. The User is responsible for maintaining the User’s own backups of the User’s data. Mali does not provide any sort of compensation for lost or incomplete data in the event that backups do not function properly. Mali will do its best to ensure complete and accurate backups, but assumes no responsibility for this duty. This does not apply to purchases: Premium Features you have paid for can always be restored through “Restore purchases”.

Links to other applications or websites
Mali may contain links to other websites, mobile apps, or third-party services. Such links are provided for your convenience only, and the User accesses them at the User’s own risk. Mali is not, directly or indirectly, implying any approval, sponsorship, endorsement, or affiliation with any linked mobile application or websites, unless specifically stated herein. Mali does not warrant the offerings of any businesses or individuals or the content of their mobile applications or websites. Mali does not assume any responsibility or liability for the actions, products, services, and content of any other third parties. The User should carefully review the legal statements and other conditions of use of any mobile application or website which the User accesses through a link from Mali. The User’s linking to any other application or website is at the User’s own risk.

Mali welcomes links to us but only in strict accordance with our terms and conditions. Mali reserves the right to revoke the User’s right to link to Mali upon notice. If the User receives such a notice from us, the User agrees to discontinue the User’s link to the Services.

Advertisements
Premium subscription or features may not remove all forms of advertising and sponsored content.

During the use of Mali, the User may enter into correspondence with or participate in promotions of advertisers showing goods, hyperlinks, advertisements, or services. Any such activity, and any terms, conditions, warranties, or representations associated with such activity, is solely between the User and the applicable advertiser. Mali shall have no liability, obligation, or responsibility for any such correspondence, purchase, or promotion between the User and any such third party. The User’s use of such sites, including their content, products, or services, is solely at the User’s own risk.

Mali is not implying any approval, association, endorsement, or affiliation with any content provided by or linking to third-party sites or applications. Mali does not assume any responsibility or liability for the actions, products, services, content, any loss or damage of any kind from any dealings between the User and any third parties, or as a result of the presence of such third parties’ information, content, or services.

Intellectual property rights
This Agreement does not transfer to the User any intellectual property owned by Mali or third parties. All trademarks, service marks, graphics, and logos used in connection with Mali or 

Services are trademarks or registered trademarks of Mali or Mali licensors. Other trademarks, service marks, graphics, and logos used in connection with the Services may be the trademarks of other third parties. The User’s use of our Services grants the User no right or license to reproduce or otherwise use any Mali or third-party trademarks. The User agrees not to remove or obscure any copyright notices displayed on, used in, or in conjunction with the Content. The User also agrees that the User has no right to access, view, or alter any source code of Mali.

Limitation of liability
To the maximum extent permitted under applicable Thai law (including the Unfair Contract Terms Act B.E. 2540), Mali, its affiliates, directors, employees, or partners shall not be liable for any indirect, incidental, special, punitive, or consequential damages whatsoever arising from your use of the Services.

Nothing in this Agreement shall exclude or limit Mali’s liability for death, personal injury, or damage to health caused directly by Mali’s gross negligence or willful misconduct. For all other commercial, financial, or technical claims, Mali’s aggregate liability shall be strictly capped at the total amount actually paid by the User to Mali in the twelve (12) months preceding the event giving rise to the claim, or 1,000 Thai Baht (THB), whichever is higher.

Indemnification
The User agrees to hold Mali and its affiliates, directors, officers, employees, partners, and representatives harmless from and against any liabilities, damages, or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to the User’s Content, the User’s use of the Mali or Services or any willful misconduct on the User’s part.

Severability
All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws. They are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid, or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force.

Dispute resolution
The formation, interpretation, and performance of this Agreement, and any disputes arising out of or in connection with it, shall be governed exclusively by the substantive and procedural laws of the Kingdom of Thailand. Any legal action, suit, or proceeding arising out of this Agreement shall be brought exclusively before the competent courts of First Instance located in Bangkok, Thailand, and the User hereby unconditionally submits to the personal jurisdiction of such Thai courts. This clause does not remove any protection, or any right to bring proceedings, that the consumer law of your country of residence gives you and that cannot be waived by contract.

Changes and amendments
We reserve the right to amend our terms at any time to reflect updates to our Services, operational practices, or statutory requirements under the Thai Personal Data Protection Act (PDPA). For non-material updates, changes will become effective immediately upon posting the revised text with an updated ‘Last Updated’ date.

In the event of material changes, we will notify you at least thirty (30) days in advance via your registered email address or a prominent in-app notification. If you decline to provide consent to material updates necessary for the performance of our contract, we may be unable to continue providing certain features of the Services.

Acceptance of these terms
The User acknowledges that the User has read this Agreement and agrees to all its terms and conditions. By using Mali or its Services, the User agrees to be bound by this Agreement. Before any purchase, the app shows links to this Agreement and the Privacy Policy, and by confirming the purchase, you accept them. If the User does not agree to abide by the terms of this Agreement, the User is not authorized to use or access Mali and its Services.

App Store and Google Play terms
If you downloaded the app from the Apple App Store: Apple’s terms govern your purchase and payment, and Apple’s standard Licensed Application End User License Agreement also applies to your use of the app. Apple is not a party to this Agreement and is not responsible for the app.

If you downloaded the app from Google Play: Google’s terms govern your purchase and payment. Google is not a party to this Agreement and is not responsible for the app.

Language
This Agreement is published in English, Thai and Vietnamese. For users in Thailand, the Thai version prevails; for users in Vietnam, the Vietnamese version prevails; for all other users, the English version prevails.
